Refund policy

Capitalised terms shall have the meaning given to them in the applicable General Terms and Conditions of Sale, depending on whether the customer is a consumer (B2C) https://pilatesme.com/pages/terms-conditions-retail or a professional customer (B2B) https://pilatesme.com/pages/b2b-terms-and-conditions. This Refund Policy does not replace the applicable General Terms and Conditions of Sale, which shall prevail in all circumstances over this Refund Policy.

Article 1 – Order cancellation before shipment

For consumers (B2C)

Any Order for Products other than customised Products may be cancelled by the Customer up until Shipment. The Total Price shall be refunded by Monesty to the Customer.

For professional customers (B2B)

Any Order for Products other than customised Products may be cancelled by the Customer up until Shipment. In the event of cancellation, unless otherwise decided by Monesty and communicated in writing, the Deposit shall remain the exclusive property of Monesty.


Article 2 – Right of withdrawal

For consumers (B2C)

The Customer has the right to cancel the Order and return the Products for any reason whatsoever in accordance with their statutory rights (the Right of Withdrawal). Any exercise of the Right of Withdrawal must be notified by the Customer to Monesty in a clear and unequivocal written statement within thirty (30) days of delivery of the Products or, in the case of an Order containing several Products, within thirty (30) days from the date on which the Customer, or a person designated by the Customer, physically takes possession of the final Product included in the Order.

Once the Customer has notified Monesty of their intention to return the Products, the Customer must return the Products together with the original invoice, in their original packaging and with all included accessories, within thirty (30) days following such notification.

Notwithstanding the foregoing, the following Products shall not be eligible for the Right of Withdrawal:
Products whose price depends on fluctuations in the financial market which are beyond Monesty's control and which may occur during the withdrawal period;
Products made to the Customer's specifications or clearly personalised;
Products liable to deteriorate or expire rapidly;
sealed Products which are not suitable for return for health protection or hygiene reasons and which have been unsealed by the Customer after delivery; and
Products which, after delivery and due to their nature, become inseparably mixed with other items.

If the Products in respect of which the Customer exercises the Right of Withdrawal have been damaged after delivery, Monesty shall deduct the resulting decrease in value of the Products from the refund amount.

Delivery costs relating to Products for which the Customer exercises the Right of Withdrawal shall be borne by Monesty, except for any additional delivery costs resulting from the Customer choosing a delivery method other than Monesty's standard delivery method and except for return shipping costs, which shall be borne by the Customer.

Any refund payable by Monesty shall be made within fourteen (14) days from notification of the exercise of the Right of Withdrawal, provided that such period shall not expire before Monesty has received the Products. Unless otherwise instructed by the Customer within this period, the refund shall be made to the same bank account from which the Total Price was paid.


Article 3 – Lack of conformity / defect / return related to a product issue

For consumers (B2C)

Unless expressly provided otherwise in the applicable General Terms and Conditions of Sale, the Products are sold in a condition that is normal for goods of the same type. Monesty gives no guarantee regarding the performance, lifespan, use and/or ageing of the Products. Monesty shall also not be liable for any unforeseeable, unusual and/or indirect damage resulting from the performance of the Order, nor for any damage resulting from maintenance that does not comply with Monesty's instructions.

Monesty shall be liable for any lack of conformity within the meaning of Article 1649ter of the former Civil Code appearing within two (2) years of delivery of the Order, provided that the Customer has notified Monesty of such lack of conformity in writing within two (2) months from the date on which the Customer identified the defect. Such notification must include a precise description of the defect and/or fault, supported by photographic evidence. Failure to notify Monesty within this period shall be deemed acceptance of the defect and/or fault by the Customer. In the event of a defect, the Customer shall have the right to require Monesty to repair or replace the Product or, where applicable, to grant a price reduction or cancel the Order, in accordance with the conditions set out in Article 1649quinquies of the former Civil Code.

For professional customers (B2B)

Unless expressly provided otherwise in the applicable General Terms and Conditions of Sale, the Products are sold in a condition that is normal for goods of the same type. Monesty gives no guarantee regarding the performance, lifespan, use and/or ageing of the Products. Monesty shall also not be liable for any unforeseeable, unusual and/or indirect damage resulting from the performance of the Order, nor for any damage resulting from maintenance that does not comply with Monesty's instructions.

Any lack of conformity and/or hidden defect existing at the time of delivery must be notified by the Customer to Monesty in writing within seventy-two (72) hours from delivery in the case of visible faults and/or defects, or from discovery in the case of hidden faults and/or defects and, in all cases, within two (2) years from the date of delivery. Such notification must include a precise description of the defect and/or fault, supported by photographic evidence. Failure to provide such notification within this period shall be deemed acceptance of the defect and/or fault by the Customer.


Article 4 – Pilates&Me Warranty

For consumers (B2C)

Any defect covered by the Warranty referred to in the applicable General Terms and Conditions of Sale must be notified by the Customer to Monesty in writing within thirty (30) days of its discovery. Such notification must include a precise description of the defect, supported by photographic evidence. Failure to notify Monesty within this period shall be deemed acceptance of the defect by the Customer.

For professional customers (B2B)

Any defect covered by the Warranty referred to in the applicable General Terms and Conditions of Sale must be notified by the Customer to Monesty in writing within thirty (30) days of its discovery. Such notification must include a precise description of the defect, supported by photographic evidence. Failure to notify Monesty within this period shall be deemed acceptance of the defect by the Customer.


Article 5 – Return conditions

For consumers (B2C)

All returns made in accordance with these General Terms and Conditions of Sale, except for returns relating to the exercise of the Right of Withdrawal, must be shipped in accordance with the instructions provided by Monesty and no later than thirty (30) days after the Customer sends Monesty the notifications referred to in Clauses 7 and 8.

All return, delivery and inspection costs shall be borne by Monesty unless it is determined that Monesty is not responsible for the circumstances that gave rise to the return under the applicable General Terms and Conditions of Sale, in which case such costs shall be borne by the Customer.

Any refund payable by Monesty shall be made within thirty (30) days from the final determination of the applicable treatment of the relevant defect and/or fault. Unless otherwise instructed by the Customer within this period, the refund shall be made to the same bank account from which the Total Price was paid.

For professional customers (B2B)

All returns made in accordance with the applicable General Terms and Conditions of Sale must be shipped in accordance with the instructions provided by Monesty and no later than thirty (30) days after the Customer sends Monesty the notifications referred to in Clauses 7 and 8.

All return, delivery, inspection, storage, packing and picking costs shall be borne by the Customer, except where a defect and/or fault is attributable to Monesty under the applicable General Terms and Conditions of Sale, in which case Monesty shall bear such costs.

Any refund payable by Monesty shall be made within fifteen (15) days from the final determination of the applicable treatment of the relevant defect and/or fault. Unless otherwise instructed by the Customer within this period, the refund shall be made to the same bank account from which the Total Price was paid.

All returns of Products for which Monesty is not responsible shall be subject to administrative and transport fees of EUR 200.

Monesty shall have the right to retain any Products concerned by a return until the Customer has paid in full all amounts owed by the Customer to Monesty.


Article 6 – Refunds

In all other cases and without prejudice to any statutory and/or contractual rights of the Customer, any refund shall, where applicable, be granted at Monesty's sole discretion. Any refund granted shall be exceptional and shall under no circumstances create an entitlement to any further refund.

For professional customers (B2B)
